The Board is not in a position to enter into a contract given the short notice. Based upon our discussion yesterday, I am assuming there will be no broadcast until an arrangement is reached with Mt. I am responding to your letter to Pastor Leslie Braxton in my capacity as Chairman of the Trustee Ministry. Legal contracts fall into the domain of this ministry. Mount Zion Baptist Church values our relationship with Kris Bennett Broadcasting. So that we may maintain that partnership, I would like to share with you the process that the Trustees follow when reviewing, negotiating and deliberating on a contract.1. The agreement is reviewed by the entire Trustee Ministry to identify potential benefits and any concerns that the church may need to address or at least be aware of.2. The agreement is put to a vote on whether we should proceed to the next step, legal review, or if we should reject it.3. If approved, the agreement is sent to our legal counsel for review and identification of concerns or issues that need to be addressed. 4. Once given a clean review by our legal counsel the agreement is presented to our congregation, if necessary, for a vote. If approved by the congregation the chair of the Trustees then signs the agreement.5. If congregation approval is not necessary, the Trustees already have the authority to enter into the agreement, then the chair signs the agreement.Because it is our obligation to conduct this process, I regret that we will not meet your stated deadline of March 23. We have an important fiduciary responsibility to make the best possible decisions for our church and we take that seriously. Your proposal would add more than $10,000 to our current annual budget. Before we can commit the church to such an increase and make the appropriate budgetary adjustments, we are obligated to review all of our options.To aid our negotiation, our review will include (but not be limited to) the following steps:1. Determine what the current market rate for this type of service is.2. Determine what other broadcast options are available to Mt. Zion.3. Determine if other churches currently broadcast by KBB are being asked to sign similar agreements. Once our fiduciary and legal reviews are complete, I will be prepared to discuss terms with you. I will commit to getting back to you by the end of the month. Until then I propose that we continue to operate under the same terms and conditions, $200 per week, which we have operated under for the past few years. We have a long and mutually beneficial history together and I hope that we can continue that history during this most important season of our faith. In the interim, I recognize that you may decide not to proceed in the spirit of public service by canceling our live Easter broadcast and subsequent services. As I pointed out earlier, Wednesday, March 23, 2005, that the Agreement was withdrawn in its entirety after that deadline passed at the end of that business day. Afterward the agreement was on a first come, first come basis, unfortunately, your tardy response to the Mt. Zion’s trustees self-impose time table expired. For your info, Miracle Temple Church of God In Christ, is the new live primetime broadcast ministry on Kris Bennett Broadcasting, Inc. just in case you, as the new chair of the trustee board, personaly wish to share this info to those sick and shut-in members of our church-Mt. Zion -that may need this broadcast ministry. If you are unsuccesful in getting a commercial radio station to broadcast Mt. Zion’s worship services, please contact me regarding a more affordable delayed broadcast avails opportunity on Kris Bennett Broadcasting, Inc. That door is still open for OUR Church. That was truly not my intent. I am pleased to learn from your e-mail that you have a replacement for the live broadcast slot, and again I wish you well on your future endeavors. After more than 20 years of partnership it’s unfortunate that we were not able to come to a different conclusion. Perhaps any future business will allow us both the time and opportunity to negotiate a mutually beneficial agreement under more relaxed deadlines. Please know that I am writing this e-mail from my home, as per your request. I assure you that everything I did previously was done on my own time. Apology is accepted. However, since this was a business matter I am not sure if it is warranted. In business contracts, agreements and negotiations these things happen. As I mentioned that our Sunday Broadcast Ministry is sold-out. So the moment that Mt. Zion Baptist Church of Seattle Senior Pastor expressed a desire, after over 21 years, 10 years at no charge in this prime time slot, to not be on the only Black Owned Radio Stations in Washington and Oregon, Mt. Zion’s slot was taken immediately. As you know there were not any negotiations, nor were there any phone calls from the Senior Pastor or you concerning this matter. A good faith professional phone call, similar to Deacon Joel Hobbs call for Palm Sunday broadcast, from the Senior Pastor or you could have prove pivotal in this matter. Mr. Nellams, you are a young family man with a bright future, it is not my desire nor intent to bring unnecessary career harm to a promising future. My concerns were real, up front and spiritually motivated. Trust me I know governmental procedures very well. To do otherwise, in this matter, would destroy all that we marched and fought for in the civil rights arena.
